By accessing or using the Mitch Solutions website and products, including Cimfoni, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services. These terms apply to all visitors, users, and others who access or use our services.
2. Description of Services
Mitch Solutions provides operational technology solutions for organizations managing facilities, people, and services. Our flagship product, Cimfoni, is an operations management system designed for residential facilities and multi-site operations. Access to Cimfoni is provided through individual service agreements and pilot programs.
3. User Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to use our services to:
Violate any applicable laws or regulations
Infringe upon the rights of others
Transmit any harmful, threatening, or objectionable content
Attempt to gain unauthorized access to our systems
Interfere with the proper functioning of our services
5. Intellectual Property
The service and its original content, features, and functionality are and will remain the exclusive property of Mitch Solutions. Our service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

Your use of our services is also governed by our Privacy Policy. For organizations using Cimfoni, data handling, storage, and processing terms are defined in individual service agreements. We are committed to maintaining the confidentiality and security of all data processed through our platform.
7. Service Availability
We strive to maintain high availability of our services but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice. Scheduled maintenance windows will be communicated in advance to active users.
8. Limitation of Liability
In no event shall Mitch Solutions, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.
9. Governing Law
These terms shall be governed and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these terms will be resolved in the courts located in New York County, New York.
10. Changes to Terms
We reserve the right to modify or replace these terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
